Applicant requests relief from §330-11 (residential district dimensional regulations) for the following: (i) an accessory distance from street setback from 70 feet to 10 feet for the proposed swimming pool, (ii) an accessory distance from street setback from 70 feet to 50 feet for the proposed shed, and (iii) accessory side yard setbacks from 20 feet to 10 feet for the proposed swimming pool and proposed shed. In addition applicant requests relief from §330-76D (placement of accessory buildings and uses in all districts) and §330-83C (yards) to allow the proposed swimming pool and proposed shed to be located within the required minimum and total side yard for the principal building. Applicant also requests relief from §330-55B(1) (transfer of development rights procedure) for a principal front yard setback from Elm Street from 30 feet to 15.9 feet for a proposed roof over an existing patio on a nonconforming lot and any other relief necessary.

On July 1, 1999, by decision number D10368, this Board granted the applicant relief for a 396 square foot second floor addition to an existing single family dwelling. As stated in a notation dated November 4, 2013, on the plans of James V. Deluca, dated May 4, 2008, last revised October 28, 2013, the previously granted addition encroaches into the pyramid by 2,016 cubic feet which is 252 square feet of the proposed addition. A letter was received on November 1, 2013 from Rosemary Mascali stating the second floor addition that was granted in 1999 was never constructed and they are now ready to proceed with the construction of the second floor but must now comply with the VE12 Flood Zone regulations. In order to comply with the flood zone regulations, an additional 500 cubic feet of pyramid relief is required. Since there was no change to the design and square footage of the proposed second floor addition granted in 1999, the applicants are requesting that the Board deem their request for the additional 500 cubic feet of pyramid relief as an amendment to the original decision.
