RESCISSION OF EMERGENCY DESIGNATION OF SHELLFISH LANDS IN THE STATE OF NEW YORK AS UNCERTIFIED FOR THE HARVEST OF SHELLFISH

Pursuant to the provisions of Subdivisions 13-0307 (1) and (2) and Subdivision 13-0309

(1) of the Environmental Conservation Law and Sections 42.17 and 47.4 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, and based upon the determination that conditions that may cause shellfish to be hazardous for use as food are no longer present, I, Debra A. Barnes, Chief, Bureau of Shellfisheries of the Department of Environmental Conservation, hereby rescind specific sections of the order dated December 11, 2023, that designated particular shellfish lands as uncertified for the harvest of shellfish. This order is effective at 12:00 P.M. EST, Thursday, December 14, 2023, and applies only to the areas described below, except as described in 6NYCRR, Part 41, "Sanitary Condition of Shellfish Lands".

Accordingly, the harvest of shellfish from the following areas is permitted:

Town of Shelter Island: All the normally certified areas of West Neck Harbor including its tributaries.

Town of Southold: All the normally certified tributaries of Orient Harbor including Spring Pond, Dam Pond, Oyster Ponds Creek, and Hallock Bay and all the normally certified areas of Goose Creek, Jockey Creek, and Town Creek which are tributaries of Southold Bay.

Town of Southampton: All the normally certified areas of North Sea Harbor and its tributaries and Wooley Pond.

I hereby certify that this is the original thereof.
