2. Why do the fire marshals perform business inspections?

New York State mandates that compliance inspections be made in all businesses. In general, business inspections are performed annually, but public assemblies are required to be inspected twice per year because of the increased hazards associated with them. Compliance checks help to discover violations before them become active problems.

3. What are some of the things the fire marshal looks for when inspecting a business?

Fire marshals look for safety hazards and to determine compliance with applicable codes. Some of the things looked for, include:

• Electrical, gas, heating systems are being safely maintained.
• Required systems, such as automatic fire suppression in commercial kitchens, fire alarm systems, and fire sprinklers are properly maintained and inspected.
• Extension cords cannot be used in place of permanent fixed wiring.
• Operational exit lights.
• Fire extinguishers are in proper locations and have been inspected by a company licensed within Suffolk County.
• Street numbers are visible.
• Dumpster is in compliance for location, as well as enclosure.

In addition, New York State requires annual permits for facilities with greater hazards. Inspections address specialized operations such as:

• Service stations with flammable liquid storage.
• Marinas with electrical wiring in wet locations.
• Bed and breakfasts, motels, and apartment complexes.
• Bars, nightclubs, and other public assemblies.
• Special events and temporary tents.
• Welding and other hot work.
• Storage of hazardous materials.
• Lumberyards and wood working facilities

4. If the Fire Marshal finds violations, do I get a warning or a summons?

If the violation is not considered a life safety hazard, you will have a certain amount of time to correct the problem. If the problem is a life safety hazard, or if the inspection history reveals a repeating problem, the fire marshal may issue you a summons. If you are given time to comply, the fire marshal will come back for a re-inspection. All violations should be corrected as soon as possible, even if the Fire Marshal indicates that they may not be back immediately for the re-inspection.

5. What should I do if I receive a Notice of Violation?

There should be specific information in the Notice of Violation that was posted, or the letter you received. The information for contacting the Fire Marshal will be on the form or letter. Each fire marshal has a direct telephone number. If you do not receive a return call, try the department’s general number at 631-702-2919.

6. How do I report a violation?

By telephone, a citizen can report a complaint by calling 631-702-2919 during regular business hours (Monday through Friday 8:30 a.m. - 4 p.m.). A staff member will take the information regarding the location and nature of the violation.

7. Can I make an anonymous complaint?

8. What happens after I make my complaint to the Fire Marshal?

The fire marshal assigned will investigate your complaint. If it is determined that a violation exists, the fire marshal may issue a notice of violation or a summons, depending on the nature of the violation. If the problem is not a life safety problem, the fire marshal may work with the individual responsible for the property for a brief period of time to achieve compliance. Some permits may be required for some repairs, from either the building department, fire marshal’s office or both.

9. How do I obtain copies of violations on a piece of property?

10. Do I have to renew operating permits every year?

Yes, New York State has set the time frame as annual. It is the responsibility of the business owner to check on the renewal prior to the expiration of the permit. For additional information, please call the Fire Marshal Office at 631-702-2919

11. Am I allowed to burn a fire in a barrel in my yard?

No. Open burning is severely restricted by local and New York State codes. The Town’s Department of Parks and Recreation does allow for limited use of fire with a valid facility use permit. Click here to download permit application SH-PR-004. Failing to comply with restrictions may result in the issuance of summonses.

12. How do I apply for a tent permit?

In general, the tent company handling the transaction will make the application. If an individual wants or needs to make the application directly, they can download the application or call 631-702-2919 to have one faxed or mailed.

13. I am having a party/event. Where can people park?

If there are signs posted, the regulations in place there apply. If it is an area without signage in a residential area, safe parking is allowed on the sides of the roadway, with the exception of between 1 a.m. and 6 a.m. If access by emergency vehicles is inhibited, tickets may be issued for safety violations even if there is no signage.

If you anticipate more vehicles than your yard or neighboring street can handle, it is recommended that you find an alternate area to park the excess vehicles.
